Refund Policy
Important: All purchases made using the Seatme Platform are final, and no refunds will be offered for any reason, including Force Majeure, subject to the Consumer Protection Act and other applicable laws.
This Refund Policy summarises refund-related provisions of our Website Terms and Conditions of Agreement ("Terms"). Where anything here differs from the Terms, the Terms prevail. Seatme is a division of Atterbury Trust (Registration No: IT4555/98).
1. General refund policy
1.1 All purchases made using this Platform are final, and no refunds will be offered for any reason, including, without limitation, the occurrence of an event of Force Majeure (as described in section 4 below), subject to the applicable provisions of the Consumer Protection Act 68 of 2008 ("Consumer Protection Act") and / or any applicable laws.
1.2 Gift Card balances that remain unused after use of the card are not redeemable for cash or refund, except where applicable law requires otherwise (see section 6 of the Terms regarding Gift Cards).
2. Refunds required by law or merchant discretion
2.1 Should the Consumer Protection Act or any applicable laws so require, or otherwise in the sole discretion of the applicable Merchant (in respect of which the Event relates), we will provide the necessary refund, through the original payment method or any digital wallet facility, where available, on our website (only) in the form of a credit, to the value of the applicable ticket, for the ticketholder to make use of on a future date for either the same, rescheduled, Event or for a different Event or Service, as permitted by any applicable laws.
2.2 Where tickets are sold for an Event created by a Merchant, the Merchant (as event organiser / promoter) bears primary responsibility to ticket purchasers for cancellations, postponements, exchanges and refunds relating to the Event, as set out in the Merchant User Ticketing Agreement. Seatme acts as a facilitator and may process refunds on the Merchant's behalf where required by law or reasonably required to comply with other applicable laws; the Merchant must reimburse Seatme for any refunds and related costs, as set out in that agreement.
3. Dissatisfied with a credit refund
Should you be dissatisfied with receiving a refund in the form described in section 2, you are welcome to log an official written complaint (see section 6 below) and we will address your specific complaint on a case-by-case basis.
4. Force Majeure
We are not responsible and cannot be held liable for any losses suffered by you as a result of our non-performance, partial performance or delayed performance, resulting wholly or partly from circumstances beyond our reasonable control, including but not limited to:
- civil commotion, labour disturbances, riots, blockades, embargo, strikes, lock-out or public disorder, endemics, pandemics, or related activities;
- war, invasion, hostilities or warlike operations (whether declared or not) or civil war; or
- acts or omissions of third parties, including governmental authorities, or where staff reasonably deem that your safety or property might be in jeopardy.
We will use all reasonable endeavours to continue to perform our duties on the Platform, but shall have no liability to you should performance not be reasonably executable due to factors beyond our control.
5. Event cancellations, postponements and surcharges
5.1 Cancellations, postponements and rescheduling of Events are handled in line with the Terms, applicable law, and any agreement between Seatme and the relevant Merchant.
5.2 We may impose a surcharge in certain circumstances (for example, where an Event is cancelled or rescheduled due to circumstances beyond our control, or where supply-chain costs increase beyond our control). We will, however, use all reasonable endeavours to keep to published prices and will address grievances on a case-by-case basis.
6. Ticket transfers and resale
Any transfer or re-sale of your ticket is entirely at your own risk. Seatme shall not be held liable for any issues, disputes, or losses arising from the transfer or resale of any tickets. Entry to an Event is granted strictly on a "first scan wins" basis. The original purchaser bears sole responsibility for ensuring the legitimacy and security of any transfer or resale. 7. Complaints and contact
7.1 All complaints should be made in writing via e-mail to info@seatme.co.za, no later than 15 business days after any incident occurred.
7.2 For queries that can be resolved more easily, you may call (+27) 71 686 7733. We will use all reasonable endeavours to resolve complaints swiftly, but this cannot be guaranteed where we are bound by third-party agreements or Force Majeure applies.
7.3 Should an incident go unreported, please refrain from making any related broadcast on public websites / online platforms, as this may lead to a claim against you for defamation of character.
